These are the published ACC guidelines as of 9/30/2021. Publishing these guidelines does not prevent the Home Owners Association from changing this document from time to time when necessary to promote the common good of the community and protection of property values.
These design standards combine language from the CBL Covenants with the proven guidelines that have made CBL the desirable development that it has become and to maintain that status. The covenants clearly state that an activity of the ACC is to adopt and promulgate the design standards and shall, as required, make findings, determinations, rulings, and orders with respect to the conformity with our design standards. The ACC uses the current covenants (July, 2021) to guide in decision making. Answers to several homeowner questions are provided. (Section 5.5. July, 2021)
Set backs: Each dwelling shall abide by having a total setback of ten feet from the side boundary lines, not less than three from either side. A dwelling erected must be set back 15 feet from the front boundary and ten feet from the rear lot line. (Section 6.10. July 2021)
Reconstruction: A home that is reconstructed as a result of fire, natural disaster, code compliance, and/or discretion of property owner must be of the same or greater square footage to include the footprint of the original structure. All reconstructed buildings are to match original roof slopes and original cladding (i.e. brick or brick with Hardie/vinyl on gable ends above the roof bearing; except Silo Alley and 40 Angus Run Hardie with stone veneer fronts.)
Restrictions: All one story dwellings shall have a minimum of 1550 square feet of heated living area as defined in the covenants. Roofs shall be not less than 6:12 pitch, with not less than 12 inch overhang. (Section 6.4. July, 2021) Except 1550 square feet is the smallest home size currently in Cliffabee Leas and to be consistent with “Reconstruction”.)
Landscaping: No new landscaping, or enlarged area of present landscaping, on any lot shall take place without application and written approval of the ACC of plans and specifications. Present landscaping may be altered or modified without prior written approval. (Section 6.7 July, 2021). Comment: Front yards are grass to maintain consistency within the community.)
Trees: No living tree having a diameter of six inches or more shall be removed from any lot unless such removal is in conformity with approved landscaping plans. (Section 6.8 July, 2021)
Exteriors: The original builders color coordinated certain exterior materials. Repair or repainting the type of materials and original colors must be used. Materials as near the original as possible may be substituted if the original is not available. Exterior trim, garage doors, siding and roofing shall remain as similar as possible to the original. Solar Panels: No solar panels shall be placed, allowed or maintained on any structure or lot that would be visible from any other lot. (Section 6.22. July, 2021)
Fences: No above ground fence or wall of any type shall be erected, or altered on any lot. The original “Southern Homes” built homes that included decorative front fencing may be removed or must be maintained in good condition. “Southern Homes” decorative front fencing may be converted to wrought-iron. Underground fences may be installed for small pets (i.e. dogs). The ACC position of no fences is based on Section 6.11 July, 2021 (to facilitate yard maintenance, and to promote the natural look of the community.)
Character of the Community: Any construction, new or alteration, upon any lot shall be built to maintain the character and feel of the community. Structures built by the original developers were grouped as to keep the neighborhood feel (e.g. all brick or Hardi board with stone accents), fully sodded front and side yards, concrete flatwork (e.g. driveways and sidewalks). Trim colors were kept to a minimum allowing for continuity while maintaining the individual appearance of each home. The overall color pallet is of Earth Tone colors (as compared to beach colors one would expect to see in the coastal/beach areas). (Section 6.20 July, 2021).
